Terms of Service
Luxstella LLC (hereinafter referred to as “the Company”) establishes the following Terms of Use (hereinafter referred to as “the Terms”) regarding the use of the provided services (hereinafter referred to as “the Services”). Please note that customers (hereinafter referred to as “you”) who use the Services are deemed to have agreed to these Terms in advance and to use the Services accordingly.
Article 1: Scope of Application
These Terms shall apply in the following cases:
- These Terms shall apply to all services provided through the Services.
- Users of the Services shall be deemed to have understood and accepted all the contents of these Terms.
Article 2: Prohibited Activities
You shall not engage in the following activities when using the Services:
- Acts that violate laws or public order and morals.
- Acts related to criminal activities.
- Acts that disrupt or interfere with the functioning of the Company’s servers or networks.
- Acts that interfere with the operation of the Company’s services.
- Impersonation of other customers.
- Acts that directly or indirectly provide benefits to anti-social forces in connection with the Company’s services.
- Any other acts deemed inappropriate by the Company.
Article 3: Customer’s Responsibility
You shall bear the following responsibilities when using the Services:
- You shall use the Services at your own discretion.
- You shall be solely responsible for the accuracy and content of the information you register.
Article 4: Deletion of Information
The Company may, without prior notice, restrict your use of all or part of the Services, or delete your registration as a customer, in the following cases:
- Violation of any provision of these Terms.
- Discovery of false information in the registered details.
- Any other cases where the Company deems the use of the Services inappropriate.
The Company shall not be liable for any damages incurred by you as a result of actions taken by the Company under this article.
Article 5: Use of Provided Information
The Company may use the information provided by you in the following cases:
- The Company and its affiliates may contact you by email, direct mail, postal mail, telephone, or other means in connection with the provision of the Services.
- With regard to the information you have registered, except for information that identifies individuals such as names and addresses, the operator is deemed to have been granted the right to use (including the right to sublicense) such information free of charge, on a non-exclusive basis, both within Japan and internationally, for purposes such as reproduction, publication, transmission, distribution, transfer, lending, translation, and adaptation. In addition, you shall not exercise any moral rights as an author.
Article 6: Handling of Personal Information
Please refer to the “Privacy Policy” for the handling of personal information in the Services. By using the Services, you are deemed to have accepted the Privacy Policy.
Article 7: Change in Service Content
The Company may change the content of the Services or suspend the provision of the Services without notifying you, and shall not be liable for any damages incurred by you as a result.
Article 8: Suspension, Termination, etc. of Services
The Company may, without prior notice, suspend or interrupt all or part of the provision of the Services if any of the following reasons exist:
- When maintenance or updates of the computer system for the Services are carried out.
- When the provision of the Services becomes difficult due to force majeure such as earthquakes, lightning, fires, power outages, or natural disasters.
- When the computer or communication line is stopped due to an accident.
- Any other cases where the Company deems the provision of the Services to be difficult.
The Company shall not be liable for any disadvantages or damages incurred by you or third parties as a result of the suspension or interruption of the provision of the Services, regardless of the reason.
Article 9: Disclaimer
The Company shall be exempt from liability for non-performance of its obligations unless it is intentional or grossly negligent.
Even if the Company is liable for any reason, it shall only be liable for damages that are normally foreseeable.
The Company shall not be responsible for any transactions, communications, or disputes between you and other customers or third parties arising from the Services.
Article 10: Email Delivery
In the Services, the Company may issue email newsletters and deliver information about services operated by the Company and its affiliates.
Article 11: Amendment of the Terms
The Company may change these Terms at any time without prior notice if it deems it necessary.
Article 12: Prohibition of Assignment of Rights and Obligations
You shall not assign or pledge, without the prior written consent of the Company, any rights or obligations under the Terms or under the terms of the usage agreement to a third party.
Article 13: Governing Law and Jurisdiction
This agreement, including guidelines and the Privacy Policy, and the relationship between you and the Company, shall be interpreted in accordance with the laws of the country where the Company operates. The laws of your country of residence shall not apply. In the event of a dispute between you and the Company, we will first seek to resolve it through mutual discussion. However, if it is still difficult to resolve, we agree to use the courts of the country where the Company operates, regardless of the reason.
